Terms of Service

These Terms of Service ("Terms") govern your use of Postinger's website, web app, API, CLI and MCP server (together, the "Service"). The Service is operated by Tuna Öcal, an individual based in Türkiye ("Postinger", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of a company, you confirm you are authorized to accept these Terms for it. You are responsible for keeping your login and API keys secure and for all activity under your account. Tell us right away at support@postinger.dev if you suspect unauthorized use.

2. The Service

Postinger lets you create, schedule and publish content to connected social media accounts, view analytics, and do the same through AI agents using our API, CLI and MCP server. Features and limits depend on your plan. We may add, change or remove features, and will give reasonable notice before removing a feature you pay for.

3. Subscriptions, payments and refunds

• Paid plans start with a 7-day free trial. Unless you cancel before the trial ends, your plan starts and you are charged.
• Plans are billed monthly or yearly in advance and renew automatically until cancelled. You can cancel at any time from your billing settings; your plan stays active until the end of the paid period.
• Payments are processed by Polar, our merchant of record, which also handles applicable taxes and invoices. Polar's terms apply to the payment.
• Refunds: if you are not satisfied, you can request a full refund within 14 days of your first payment by emailing support@postinger.dev. After 14 days, payments are non-refundable, except where the law requires otherwise.
• We may change prices with at least 30 days' notice. New prices apply from your next renewal.

4. Your content

You keep all rights to the content you upload or create with the Service. You give us a limited license to store, process and transmit that content only as needed to provide the Service, for example to publish it to the platforms you choose. You confirm that you have the rights needed to publish your content and that it complies with these Terms and the rules of each platform.

5. Acceptable use

You agree not to:

• Publish content that is illegal, infringing, deceptive, hateful, harassing or sexually exploitative.
• Send spam, create fake engagement or manipulate platform metrics.
• Connect accounts you are not authorized to manage.
• Break the terms or policies of any connected platform.
• Bypass rate limits, scrape the Service, or attack, overload or reverse engineer it.
• Resell or share access to the Service except as your plan allows.

6. Third-party platforms

The Service publishes to platforms such as Instagram, Facebook, TikTok and YouTube using their official APIs. Your use of each platform is governed by its own terms, including the YouTube Terms of Service. These platforms can change or limit their APIs at any time, which may affect the Service. We are not responsible for the platforms, their availability, or actions they take on your accounts. You can revoke Postinger's access from the platform at any time.

7. AI agents

You can connect your own AI agents to the Service. You are responsible for the actions an agent takes with the access you give it, including what it publishes. Review AI-generated content before publishing, as it can be inaccurate. Your use of an AI provider is governed by your agreement with that provider.

8. Our intellectual property

The Service, including its software, design and brand, belongs to Postinger. We give you a limited, non-exclusive, non-transferable right to use it under these Terms. If you send us feedback, we may use it without any obligation to you.

9. Privacy

Our Privacy Policy explains how we handle personal data, including data received from connected platforms and how to delete it.

10. Suspension and termination

You can stop using the Service and request deletion of your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, fail to pay, or if required by law or a platform. Where possible we will warn you first. After closure, your data is deleted as described in the Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind. We do not guarantee that posts will be published at an exact time, that the Service will be uninterrupted or error-free, or that analytics from platforms will be complete or accurate.

12. Limitation of liability

To the extent the law allows, Postinger is not liable for indirect, incidental or consequential damages, or for lost profits, revenue, data or followers. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to compensate Postinger for claims, losses and costs arising from your content, your use of the Service, or your breach of these Terms or a platform's terms.

14. Changes to these Terms

We may update these Terms. We will post the new version here and notify you by email at least 30 days before material changes take effect. If you keep using the Service after that, you accept the new Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Türkiye, and disputes are subject to the courts of Türkiye. If you are a consumer, you also keep the protections of the mandatory laws of your country of residence.

16. General

These Terms and the Privacy Policy are the entire agreement between you and Postinger about the Service. If any part is found unenforceable, the rest stays in effect. Not enforcing a right does not waive it. You may not transfer these Terms without our consent.
